The Software User





This is an agreement between the parties named above. Hereinafter known as 'the software user’ and hereinafter known as 'the supplier'. This agreement covers the supply and maintenance of the supplier’s guntrader.uk’s V6 RFD register.

Support:

Maintenance work required by faults arising from the design of the supplier's software will not be chargeable to the software user.

The software user will receive 3 months of free support and tuition (starting from the date of purchase or upgrade). After this period the software user can either purchase the guntrader support package at £12.50 per month or will be charged £60 per hour with a minimum charge of 1 hour for any ad hoc support provided. Further training and/or visits to the software user's site will be chargeable and the software user will be advised of these prior to participating.

The supplier will undertake to ensure that the software is compatible with their chosen web browser, Google Chrome.

The supplier will make every effort to carry out all maintenance, especially those that may cause downtime, outside of normal office hours Monday – Saturday and to provide the software user with a minimum of 24 hours’ notice of planned maintenance. The supplier will endeavor to minimise downtime.

Payments:

Payment is to be made by monthly or annual direct debit in advance.

In the event that payment is not received, the supplier reserves the right to place the software users’ account on hold and to bar the software user from accessing their account.

The software supplier reserves the right to apply an increase to the monthly charges on provision of 30 days’ notice in writing to the software user.

Cancellation:

The initial term of this agreement is 12 months effective from date of signature (hereinafter known as 'the fixed term’), the software user may, within 2 weeks of accepting this agreement, terminate this contract immediately on providing written notice to the supplier.

On expiry of the fixed term the software user may cancel this agreement on provision of 30 days’ notice in writing.

Data:

The supplier retains full rights to and ownership of its own data.

The software user retains full rights to, and ownership of data entered into the gun register software.

In the event the software user cancels the agreement the supplier reserves the right to make a reasonable charge for the export of the software user’s data.

Due to plagiarism by various websites, whom re-publish text and photos from the suppliers’ website claiming it as their own, we ask that you also agree to the following:

You assign to us absolutely throughout the world the entire copyright and all other rights in the nature of copyright subsisting in all materials (in whatever form including without limitation advertisements, text, photographs and graphics) which you have submitted or may in future submit for publication the suppliers website with all related rights and powers arising or accrued, including the right to bring, make, oppose, defend, appeal and obtain relief (and to retain any damages recovered) in respect of any infringement, or any other cause of action arising from ownership, of any of these assigned rights, whether occurring before, on or after the date of such assignment. You warrant and represent that you are the owner of such copyright and related rights and have all necessary power and authority to effect this assignment.
